2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 120B, 34 of the Indian Penal Code and 27 of the Arms Act.

3. As per the prosecution case, on the alleged date and time, the informant got an information that some unknown miscreants killed her husband.

4. It is submitted that informant is not an eye witness of the occurrence and she merely suspects that this petitioner might have killed her husband. It is further submitted that during entire investigation, no one has claimed to have seen the petitioner committing the offence. Except suspicion, there is no other

Patna High Court CR. MISC. No.48245 of 2023(3) dt.30-08-2023 2/2 material to show his connivance in the alleged occurrence. Similarly situated co-accused persons have already granted bail by this Court vide order dated 28.06.2023 in Cr. Misc. No. 15810 of 2023.

5 . Learned counsel for the informant and the State opposed the bail petition .

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna, in connection with Krishnapuri P.S. Case No. 422 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
