2. This application for anticipatory bail arises out of Chausa P.S. Case No. 38 of 2026 for the offence punishable under Sections 115(2), 109, 118(1), 351(2), and 3(5) of the B.N.S. and Sections 3 and 4 of the Prevention of Witch (Daain) Practices Act, 1999.

3. The case of the prosecution is that the petitioners were part of an unlawful assembly and having been armed with lethal weapons arrived at the doorstep of the informant. Pursuant to this, co-accused Kiro Mandal assaulted the informant with a sword, when Pooja Kumari tried to save the informant, petitioner no.1, and co-accused Ravi Kumar,

Patna High Court CR. MISC. No.48809 of 2026(2) dt.22-07-2026 2/3 assaulted her on the head by means of sword. It is further alleged that the second daughter of the informant, namely, Aarti Kumari, was assaulted on her head by co-accused Mukesh Kumar.

Learned counsel for the petitioners has submitted that there is general and omnibus allegation against the petitioner nos. 2 and 3, while the injuries sustained by Pooja Kumari are simple in nature caused by hard and blunt substance whereas the same is attributable to co-accused Ravi Kumar and petitioner no. 1. It has further been submitted that the injury report does not corroborate the allegation against the petitioners as the petitioners are alleged to have assaulted by means of sword (sharp cutting weapon), but the injuries have been opined to be caused by hard and blunt substances. It has further been submitted that the petitioners' side earlier lodged a case against the prosecution party. It has lastly been submitted that petitioners have got no criminal antecedent.

5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioners.

7. Considering the facts and circumstances, let the petitioners above named, in the event of their arrest/surrender

No.48809 of 2026(2) dt.22-07-2026 3/3 within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Iind, Udakishunganj in connection with Chausa P.S. Case No. 38 of 2026, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.

8. This application stands allowed.
