JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2015 Petitioner is languishing in custody since 03.05.2014 in a case registered for the offences punishable under Sections 379, 411 of the I.P.C.

The petitioner was caught while committing theft in the mobile tower from whom one battery and cables were recovered.

It is submitted by learned counsel for the petitioner that actually no recovery was made from the petitioner but the articles were thrust upon the petitioner to implicate him in the present case.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of accusation and the fact that petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.33507 of 2014 (3) dt.27-01-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 239 of 2014.
