JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-10-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Kankarbagh Police Station Case No. 702 of 2016, disclosing offences under Sections 341, 323, 406, 420 of the Indian Penal Code and Section 138 of the N.I. Act. Learned counsel for the petitioner has submitted that the petitioner is ready to pay the entire amount in question to the informant. A Draft of Rs. 50,000/- bearing No. 000023 issued by the Central Bank of India is handed over to the learned counsel for the informant in the Court itself and the learned counsel for the petitioner undertakes to pay the rest amount in question in six installments.

No.27530 of 2017 (5) dt.04-10-2017 In view of the submission and considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Kankarbagh Police Station Case No. 702 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
