JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 The petitioner apprehends his arrest in connection with Hajipur Town P. S. Case No. 884 of 2018 registered under Sections 498A, 504 and 506/34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.
Petitioner is husband of O.P. No. 2.
Heard learned counsel for the petitioner as well as learned counsel appearing on behalf of O.P.No. 2. The matter was referred for mediation before the Patna High Court Mediation and Concilliation Centre and the report of learned Mediator dated 16.09.2019 is on record. From perusal of the same, it appears that parties have already settled their dispute mutually
Patna High Court CR. MISC. No.42410 of 2019(4) dt.04-11-2019 2/2 before the learned Mediator and memorandum of agreement between the parties dated 16.09.2019 is also on record. In view of submissions made by the learned counsel for the parties and taking into consideration the fact that the parties have mutually settled their dispute and have entered into memorandum of agreement dated 16.09.2019, I am inclined to grant anticipatory bail to the petitioner.
Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Hajipur in connection with Hajipur Town P.S.Case No. 884 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioner will abide by terms and conditions of memorandum of agreement dated 16.09.2019.
