The petitioners apprehend their arrest in connection with Patliputra P.S. Case No.139 of 2020, registered for the offences punishable under Sections 342, 323, 324, 384 and 34 of the Indian Penal Code.
Patna High Court CR. MISC. No.56583 of 2021(3) dt.13-10-2022 2/3 The petitioners and other co-accused persons are said to have assaulted the informant by means of sharp edged weapon and knife. The accused persons also demanded money from the informant.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is also submitted that the petitioner of Cr. Misc. No.56583 of 2021 has got one criminal antecedent whereas petitioner of Cr. Misc. No.56874 of 2021 has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the entire FIR does not disclose any specific allegation against the petitioners with regard to assault and demand of money. The informant is an employee of Impressions Services Pvt. Ltd., which company belongs to the brother of petitioner, Raushan Sharma @ Raushan Kumar as stated in paragraph-11 of the bail application. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners and submitted that there is allegation of assault against the petitioners. There is no injury report on record. From perusal of paragraph-50 of the case diary, it appears that when the police demanded prescription from the informant with regard to his

Taking into consideration the fact that there is general and omnibus allegation against the petitioners, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge-XII-cum-A.C.J.M., Patna in connection with Patliputra P.S. Case No.139 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
