The petitioner seeks bail in connection with Town P. S. Case No.498 of 2021, instituted for the offences under Sections 414, 120B of the Indian Penal Code and Sections 30(a), 38(1) and 40(i) of the Bihar Prohibition and Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.08.2021 and charge-sheet has been submitted in this case.

Allegation is of recovery of 3798.72 litre of liquor from a truck and the petitioner is alleged to have been arrested from the spot.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.58072 of 2021(2) dt.07-01-2022 2/2 petitioner is neither the driver, nor the owner, nor the Khalasi of the truck rather he was standing at the place of occurrence where seizure was made and based on suspicion, he came to be arrested.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 09.08.2021 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judgecum-Special Judge, Excise Act, Begusarai in connection with Town P. S. Case No.498 of 2021.

The application stands allowed.
