Petitioners apprehend arrest in a case registered for the offence punishable under Sections 304B/34 of Indian Penal Code.

It is a case of dowry death.

Petitioner No. 1 is mother-in-law and petitioner No. 2 is sister-in-law of the alleged victim.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Petitioners are separate in mess and property. Thrust of accusation is against husband of the deceased who is already

Patna High Court CR. MISC. No.46464 of 2022(2) dt.08-12-2022 2/2 in custody. It is further submitted that at the alleged date of occurrence, due to acute abdominal pain, on the advice of the local doctor, deceased was taken to Sadar Hospital and in due course her health deteriorated and became unconscious on the way and when she reached the hospital, she was declared dead. After her death inquest was prepared on 28.02.2022 and dead body was handed over to Chandra Bhusan Kumar and Amlesh Kumar along with police constable for post-mortem. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-8th, Bhojpur at Ara in Piro P. S. Case No. 101 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
