ANJANA MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Agamkuan P.S. Case No.126 of 2017 for allegedly having committed the offence under Sections 341, 323, 365, 511 and 384/34 of the Indian Penal Code. Mr. Yogesh Chandra Verma, learned Senior Counsel appearing for the petitioner submits that though the allegation is against the petitioner as well as one Manish Kumar of having threatened to kidnap the informant, there is nothing on the record to show that threat was made earlier by the petitioner. Admittedly, there was a group of 25-30 unknown persons, who had tried to abduct the informant.

Patna High Court Cr.Misc. No.27537 of 2017 (2) dt.13-07-2017 2/2 Learned counsel further submits that similarly situated coaccused Manish Kumar has since been extended the privilege of anticipatory bail in Cr.Misc. No.21925 of 2017, vide order dated 19.06.2017.

In view of the aforementioned facts and circumstances and that the petitioner has been acquitted in one another case, which was earlier lodged against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City, in connection with Agamkuan P.S. Case No.126 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
