The petitioner is in custody since 5-5-2014 in connection with Teghra P.S. Case No. 243/2013.

It is submitted on behalf of the petitioner that the allegation against the petitioner is that he participated in an occurrence which took place leading to the murder of one Arun Singh, father of the informant Rahul Kumar. It is submitted that though in the F.I.R. the said Rahul Kumar has claimed himself to be an eye-witness to the ghastly murder of his father, yet on perusal of the case diary it is evident that the informant was informed by other co-villagers and it was only subsequently that

It is further submitted that this petitioner Lukhra @ Prem Singh has no role to play, if the F.I.R. is taken on its face value. It is further submitted that the petitioner has no criminal history.

Considering the aforementioned submission and also the fact that there is no specific allegation against this petitioner and he has been in custody for almost ten months, let the petitioner Lukhra @ Prem Singh be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai, in connection with Teghra P.S.
