JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-10-2017 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the Vigilance. The petitioners seek pre-arrest bail in connection with Mansi P.S.Case No.72 of 2017 registered under Sections 420, 467, 468, 471 and 120B/34 of the Indian Penal Code. The petitioners are working as Panchayat Teacher. They have been made accused on allegation that the documents, which they had produced at the time of their appointment, were forged. Learned counsel for the petitioners submitted that no

No.27336 of 2017 (4) dt.17-10-2017 2/3 document, which the petitioners had produced at the time of their appointment, was forged and they are ready to be present before the police or the court, as and when required, for investigation. He submitted that a large number of FIRs have been instituted in different districts of the State of Bihar and are being investigated by the Vigilance and in many of the cases the Panchayat Teachers or Block Teachers have been granted anticipatory bail by different Benches of this Court. He produced certain copies of such orders passed by different Benches of this Court in course of argument. Learned counsel for the Vigilance opposed the prayer for grant of pre-arrest bail to the petitioners.

He submitted that a large number of appointments on the basis of forged document were made and under the direction of this Court the cases are being investigated upon by the Vigilance. However, he admitted that in some of the cases lady accused have been granted anticipatory bail by different Benches of this Court. Having regard to the nature of offence and the submissions made on behalf of the parties, the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No.
