JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-08-2018 The petitioner is apprehending his arrest in connection with Sheohar P.S. Case No. 11/16, registered for offences punishable under Sections 406, 409 and 34 of the Indian Penal Code.
Petitioner happens to be the Headmaster of the Primary School in District - Shoehar and allegation against him is of defalcation of Govt. money of Rs. 6,41,163/- meant for the construction of extra class rooms.
It has been submitted on behalf of the petitioner that he has already completed the work till linter and the remaining work could not be completed due to misunderstanding and he is still ready to complete the work or to return the money. Heard learned A.P.P. also.

No.38147 of 2018 (3) dt.25-08-2018 2/2 Having heard both sides, in view of the above submission, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on provisional bail for a period of six months on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sheohar in connection with Sheohar P.S. Case No. 11/16, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, and during the above stated period of six months, the petitioner shall complete the remaining work of construction and the court below after calling for the report with regard to completion of work and after verifying the same, shall confirm the provisional bail of the petitioner else and if it is found that the construction work has not been completed, the provisional bail of the petitioner shall stand cancelled.
With the above observation and direction, this application is disposed of.
