====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 23-06-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Section 376(G) of the I.P.C. and Section 4 of POCSO Act.

Learned counsel for the petitioner submits that similarly situated co-accused Pankaj Kumar has been allowed bail by a co-ordinate Bench of this court and the petitioner is in custody since 05.12.2018.

The trial is at the verge of conclusion as per report of the trial Judge dated 05.04.2021.

Considering the aforesaid fact, I am not inclined to review earlier order of refusal of prayer for bail at Annexure-1 since the petitioner is carrying allegation of commission of rape against a minor girl. Hence, prayer for bail is refused in

Patna High Court CR. MISC. No.4006 of 2021(3) dt.23-06-2021 2/2 connection with POCSO Case No. 120 of 2016 arising out of Mahila P.S. Case No. 32 of 2016 pending in the court of learned Additional Sessions Judge-1st cum Special Judge (POCSO Act), Gaya.
