JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2018 The petitioner is apprehending his arrest in connection with Kotwali (Jogsar) P.S. Case No. 164/2018, registered for offences punishable under Sections 302, 201, 120B and 34 of the Indian Penal Code.

Allegation against the petitioner and other co-accused is of causing death of the daughter of the informant and he along with other co-accused was seen coming out from the house just after the occurrence and, thereafter, the dead body of the daughter of the deceased was found.

It has been submitted on behalf of the petitioner that materials collected during course of investigation disclosed that he has telephoned other persons and for that he has been made accused in this case and further there is no eye-witness of the

Learned counsel for the State opposed the prayer for bail and submitted that in the supervision note also, the complicity of the petitioner has been shown.

Having heard both sides, considering the facts and circumstances of the case and the nature of offence, I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is accordingly dismissed.

The petitioner, if so desire, may surrender before the court below and pray for regular bail, which will be considered by the court below on merit of the case.
