The petitioner apprehends his arrest in Maharajganj P.S. Case No. 128 of 2021, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that on the alleged date and time of occurrence, while the informant was going to purchase medicines from Hahwan market and reached near cremation ground, all the six accused persons stopped him and assaulted him with fists and slaps and knife. Petitioner inflicted knife blow which hit near his eyes.

It is submitted on behalf of petitioner that there is no allegation of repetition and as such, no offence under Section 307 IPC is made out. Petitioner is a student of intermediate class

Patna High Court CR. MISC. No.55780 of 2021(2) dt.28-06-2022 2/2 and has got clean antecedent.

Counsel for the State however, vehemently opposed the prayer for bail and submitted that petitioner caused grievous injury to the informant.

Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
