JUSTICE RAJENDRA KUMAR MISHRA ORAL JUDGMENT Date: 09-03-2015 The present contempt application is filed asserting the non-compliance of the order dated 08.08.2012 passed in C.W.J.C. No. 13516 of 2012 whereby and whereunder the respondent no.8, The Head Master Utkramit Madhya Vidyalay, Bangra, Guthani Block, Distric - Siwan was directed to examine the claims of the petitioner in the light of the discussion as made in the same. Learned S.C. 29 submits that in compliance of order dated 08.08.2012 passed in C.W.J.C. No. 13516 of 2012, the claim of the petitioner was examined by the Principal, Utkramit Madhya Vidayalay, Bangra and claim of the petitioner for joining as teacher refused, as appointment letter no. 40 dated 28.12.2010 was not issued by the concerned office. Patna High Court MJC No.6731 of 2012 dt.09-03-2015 2/2 (Establishment), Siwan issued the letter no. 4797 dated 22.10.2014 to the present Block Education Officer, Guthani, Siwan regarding verification of 28 appointment letters, including the appointment letter of petitioner by the then Block Education Officer, Guthani, Siwan, Krishna Singh, who vide letter no. 584 dated 24.10.2014 informed that all 28 appointment letters have not been issued to the office of the Block Education Officer, Guthani. Thereafter, Director (Primary) Education Department, Patna issued suspension order against Krishna Singh the then Block Education Officer, Guthani and departmental proceeding has been initiated and F.I.R. has been lodged vide Guthani P.S. Case No. 36 of 2005 on 25.02.2015, which would appear from paragraph nos. 7, 8 and 9 of the supplementary show cause filed on 03.03.2015 filed by opposite party no.2.

In view of the above submission, the order under contempt has been complied by opposite party no.2. As such, no further action is required to be taken. Accordingly, this contempt application is disposed of.
