This application, for grant of anticipatory bail, arises out of Triveniganj Police Station Case No. 328 of 2018, disclosing offences under Sections 341/323/325/307/504/34 of the Indian Penal Code.
The allegation against the petitioner is that the petitioner, along with other co-accused persons, assaulted the son of the informant, causing serious injuries. Learned Counsel for the petitioner submits that the petitioner is innocent and the parties have compromised the matter. In support of his submission, he refers to Annexure-2 to
Patna High Court CR. MISC. No.43471 of 2019(2) dt.17-07-2019 2/2 this application.
After having heard learned Counsel for the parties and taking into consideration the fact that the son of the informant has received five sharp cutting injuries, I am not inclined to grant the petitioner privilege of anticipatory bail. This application for anticipatory bail, is hereby, rejected.
The petitioner, Mukesh Kumar Yadav, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
