The petitioner is languishing in custody for the offence punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code.

The son of the informant left the house in the night after a talk with the petitioner on mobile phone. Thereafter the informant phoned to the petitioner and petitioner reported that Ajay Kumar Yadav @ Satyam, the son of the informant was with him. In the next morning, dead body of Ajay was found hanging with a tree. Suspicion is that the petitioner and others committed murder of Ajay and thereafter hanged the body to give it a case of suicide. The doctor has found asphyxial death due to pressure on the neck with hard and blunt substance.

No.1245 of 2021(3) dt.09-04-2021 2/2 Submission is that the investigation report would reveal that there is no direct evidence against the petitioner nor there is any motive against the petitioner that he would commit murder of his friend. Petitioner is in custody since 27.03.2020. Investigation of the case is already complete. Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bela (Bela Industrial) P.S. Case No. 12 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
