1. Heard learned counsel for the petitioner and learned APP for the State.
2. Petitioner seeks regular bail in connection with Complaint Case No. 878 of 2017 registered for the offence punishable under Section 498(A) of the Indian Penal Code.
3. The main submissions advanced by petitioner's counsel are that the petitioner is husband of the complainant and the instant matter is based on complaint filed by petitioner's wife and after the inquiry learned Court below has taken cognizance of the offence punishable under Section 498(A) of I.P.C. and the main allegation made by petitioner's wife is that the petitioner has developed an illicit relationship with the wife
Patna High Court CR. MISC. No.48439 of 2023(2) dt.04-08-2023 2/2 of his brother and he has been languishing in jail since 25.05.2023.
4. Learned APP appearing for the State has opposed the prayer for bail.
5. Considering the above submissions as well as the nature of allegation and custody period of the petitioner, this Court is inclined to accept his prayer for bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Complaint Case No. 878 of 2017.
