JUSTICE ARUN KUMAR ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 147, 148, 149, 341, 323, 325, 324, 307, 332, 333, 337, 338, 353, 427, 435, 504 and 120B of the Indian Penal Code.

Allegation in brief is that 500-600 persons formed unlawful assembly and variously armed blocked the road and damaging tempo passing through the road. S.D.P.O. with Magistrate and police personnel reached there and tried to pacify the mob but they were engaged in ransacking shops and setting fire in tempo. They also pelted stones to police party. It is submitted that there is general and omnibus allegation against the petitioner, in fact, he is a local people was only a onlooker so

Patna High Court Cr.Misc. No.30499 of 2017 (2) dt.07-07-2017 2/2 he has falsely been implicated in this case and another co-accused Md. Qamrruddin was earlier granted bail by a Co-ordinate Bench of this Court. The petitioner has no criminal antecedent. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Kanhaiya Manjhi @ Margitiya be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No.442 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
