The petitioners are apprehending their arrest in connection with Kotwali (Tilkamanjhi) P.S.Case nO.860 of 2017 , registered for offences punishable under Sections 420 and 406/34 of the Indian Penal Code.
Allegation against the petitioners is that they have taken Rs.02 lac for admission in the Medical College at Bhopal and thereafter two cheques of Rs.05 lac each and later on the complainant came to know that the admission in the college has already been closed, as such the petitioners had cheated the complainant.
Submission of the learned counsel for the petitioners is that
Patna High Court Cr.Misc. No.38500 of 2018 (3) dt.10-09-2018 2/2 they are still ready to return Rs.02 lac, which they have taken and so far other cheques are concerned, that have already been blocked.
Heard learned A.P.P. and the learned counsel for the informant..
Having heard both sides and in view of the facts and circumstances, as stated above , let the petitioners, above named, surrender before the court below within a period of six weeks from the date of order along with a bank draft of Rs.02 lac payable in the name of Versa Kumari and if the aforesaid amount is deposited, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five thousand) with two sureties of the like amount each to the satisfaction of CJM, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S.Case no.860 of 2017 dated 23.11.2017.
The aforesaid amount shall be released in the name of Versa Kumari, which will be subject to result of the case. With the aforesaid observation, this application is disposed of.
