2. Petitioner seeks regular bail in connection with K. Hat P.S. Case No. 626 of 2023 dated 21.05.2023 registered for the offences punishable under Sections 406, 409, 420, 379, 411, 413 and 414 of the Indian Penal Code.
3. The main submissions advanced by learned counsel for the petitioner are that the instant matter relates to the recovery of huge quantity of Government educational books from the shop of co-accused namely MD. Asfaque and the petitioner was not custodian of the seized books and he was implicated in this case mainly on account of information given by the said co-accused Asfaque and at the time of recovery, the petitioner was posted as IV Grade employee at the Government
Patna High Court CR. MISC. No.46669 of 2023(2) dt.28-07-2023 2/2 building where the alleged seized books were kept. Further submissions are that the petitioner has fair and clean antecedent and has been languishing in jail since 21.05.2023.
4. Learned APP appearing for the State has opposed the bail prayer.
5. Considering the above submissions and mainly the nature of allegation appearing against this petitioner, this Court is inclined to accept the petitioner's bail prayer. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with K. Hat P.S. Case No. 626 of 2023. (Shailendra Singh, J) annu/- U T
