The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273, 420/34 of the I.P.C. and Section 47(a) of the Bihar Prohibition & Excise Act. Total 1000 liters of spirit has been recovered from a truck, of which, this petitioner is registered owner. It is submitted on behalf of petitioner that nothing has been recovered from the possession of this petitioner and he has been made accused merely because he happens to be owner of the said truck.

However, learned A.P.P. for the State vehemently opposed the prayer for bail and submitted that petitioner is registered owner of the truck, from which, huge quantity of

Considering the same, the prayer for anticipatory bail of petitioner is rejected.
