2. The petitioner apprehends his arrest in connection with Khagaul P.S. Case No. 129 of 2025, registered for the offences punishable under Sections 308(5), 111(2), 113(3), 339, 3/5 of the B.N.S.

3. The specific allegation against the petitioner is that he delivered construction materials at the site on the instigation of co-accused Pinku Yadav. Allegation against accused persons is of demanding extortion money also.

4. The learned senior counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. It has further been submitted that

Patna High Court CR. MISC. No.46743 of 2025(3) dt.10-11-2025 2/3 the petitioner is a government employee. He is person of clean antecedent and even bare perusal of the F.I.R. He submitted further that there is no allegation against him at all, except the allegation that on the direction of co-accused Pinku Yadav, he was unloading the materials on the construction side. The reason for false implication of the petitioner is that he is relative of main accused Pinku Yadav.

5. On the other hand, the learned counsel for the informant has submitted that petitioner was supplier of the material and being a government employee, he committed dereliction of duty.

6. Be that as it may, the petitioner is a person of clean antecedent and only allegation against him that he was delivering construction materials at the site.

7. Learned APP for the State has opposed the prayer for bail of the petitioner.

8. Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the

Patna High Court CR. MISC. No.46743 of 2025(3) dt.10-11-2025 3/3 satisfaction of learned A.C.J.M.-1-cum-Special Judge, MP/ MLA, Patna in connection with Khagaul P.S. Case No. 129 of 2025, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023.

9. The petitioner will appear in the court on each and every date fixed by the trial court till framing of charges.
