The petitioner, who is in custody since 18.05.2020, seeks bail in connection with Sasaram (Mufassil) P.S. Case No. 239 of 2017, dated 01.03.2017, instituted for the offences under Sections 379, 414 and 34 of the Indian Penal Code and Sections 25(1-b)a and 26 of the Arms Act.

Patna High Court CR. MISC. No.46387 of 2022(2) dt.25-11-2022 2/3 The petitioner in the instant case has not been arrested on the spot. He has been named by one of the arrested accused persons of this case, namely, Chhotu Ram.

A raid was conducted at a place by the police party on suspicion that the criminals have assembled for committing some offence.

It has been submitted on behalf of the petitioner that nothing incriminating has been recovered from the possession of the petitioner. Regard being had to the aforesaid facts and taking into account that three other cases in which the petitioner was earlier made accused, he has been granted bail, the petitioner is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram
