The petitioner is in custody in connection with Special Trial No. 303 of 2017, arising out of Bairgeniya P.S. Case No. 64 of 2014 for the offenses under Sections 302, 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 06.08.2015. He further submits that after framing charge no step was taken by the Court below to conclude the Trial. The petitioner has no criminal antecedent. Considering the fact that the petitioner has no criminal antecedent, and he has remained in custody nearly four years, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail

Patna High Court CR. MISC. No.43382 of 2019(2) dt.15-07-2019 2/2 bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge V, Sitamarhi, in connection with S. Tr. No. 303 of 2017 arising out of Bairgeniya P.S. Case No. 64 of 2014, subject to the condition that the petitioner shall appear on each and every date fixed in the Trial. In case, without any cogent reason if he fails to attend the trail, the Trial Court shall be at liberty to cancel the Bail bond of the petitioner. (Anil Kumar Upadhyay, J) uma/- U T
