2. The petitioner apprehends his arrest in a complaint case registered for the offence punishable under Sections 120B, 341, 465, 323, 420 and 34 of the Indian Penal Code.

3. As per prosecution case, it is alleged that this petitioner, along with other accused persons, fraudulently got land of complainant executed in his favour.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is bona fide purchaser of the land which was allegedly sold by co-accused Nawal Kishore

It is further submitted that the land in question was purchased by this petitioner after payment of due consideration money and due to dispute between the complainant and his father, petitioner has falsely been implicated in this case. Moreover, the dispute is with regard to sale and purchase of land which is purely civil in nature and complainant has got other alternative remedies. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case, nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Motihari, East Champaran in connection with Complaint Case No. 2362 of 2022, subject to condition as laid down under
