JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-07-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Karpi Police Station Case No. 53 of 2017, disclosing offences under Sections 447, 147, 148,149, 341, 323, 307 and 504 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is general and omnibus allegation against these petitioners and no specific overt act is attributed to them. In fact, this case is a counter blast of Karpi P.S. Case No. 54 of 2017 filed by the petitioner no.2 against the informant. The injuries sustained by the informant side are simple in nature and caused

Patna High Court Cr.Misc. No.29507 of 2017 (2) dt.13-07-2017 by a hard and blunt substance. Moreover, co-accused Rahul Kumar has already been granted anticipatory bail vide A.B.P. No. 383 of 2017 by the learned court below. Hence, the petitioners deserve the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IVth, Arwal in connection with Karpi Police Station Case No. 53 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
