The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, four accused persons riding on two motorcycles escaped leaving behind the two sacks from which 72 litres of liquor was recovered. The petitioner was identified amongst the accused who managed to escape. It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. The cause of his false implication is his antecedent under the Bihar Prohibition and Excise Act, 2016. Co-accused Chandeshwar Singh has been enlarged on bail vide order dated

Patna High Court CR. MISC. No.55653 of 2021(2) dt.05-04-2022 2/2 24.2.2022 passed in Cr. Misc. no.50340 of 2021. The petitioner is in custody since 30.7.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having been arrested at the spot and grant of bail to co-accused Chandeshwar Singh, the Court directs the petitioner to be enlarged on bail in connection with Gopalpur P.S. Case no.54 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cumSpecial Judge (Excise), Gopalganj.
