JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307, 504/34 and other sections of Indian Penal Code.

As per prosecution case, this petitioner along with coaccused Vicky is alleged to have assaulted on the head of the informant by means of iron rod as a result of which he sustained injury.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Injury allegedly caused by petitioner is simple in nature. It is next submitted that similarly situated co-accused has already been granted bail by a co-ordinate Bench of this Court vide order dated 16.05.2022 passed in 43419 of 2021.

No.48345 of 2022(2) dt.13-12-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Rohtas at Sasaram in Dehri Town (Dalmiya Nagar) P. S. Case No. 927 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
