2. The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code as well as under Section 27 of the Arms Act.

3. The prosecution case, in short is that four accused persons looted Rs.1,70,000/- from the cabin of petrol pump and Rs.4000/- each from two nozzle men.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. It is further submitted that petitioner is not named in the FIR and his name has been transpired in this case on the basis of confessional statement of co-accused, Nishant Kumar Sahni @ Guddu Sahni. It is also submitted that co-accused, Mohan Mistri has been enlarged on bail by a coordinate Bench of this Court vide order dated 25.09.2024 passed in Criminal Miscellaneous No.56350 of 2024. It is lastly submitted that the petitioner is in custody since 01.08.2023.

5. The learned APP for the State vehemently opposed the bail application.

Considering the above facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs.Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Samastipur in connection with Sarai Ranjan P.S. Case No.166 of 2023, subject to the condition that one of the bailors must be a family member of the petitioner and the petitioner shall remain present before the Trial Court on each and every date as and when required till disposal of the case.
