JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Apprehending their arrest in connection with Fatuha P.S.Case No.541 of 2015 registered for the offences under Sections 272, 273 and 290 of the Indian Penal Code and Section 47(a) of the Excise Act, the petitioners have filed the present application under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail.

Regarding being had to the recovery of certain quantity of illicit liquor from a place where the petitioners fled away after seeing the police report, I am not inclined to grant prearrest bail to the petitioners.

Patna High Court Cr.Misc. No.29803 of 2017 (2) dt.13-07-2017 2/2 Accordingly, the prayer for grant of anticipatory bail is rejected.

In case the petitioners surrender and seek bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
