Petitioner apprehends his arrest in connection with Chanan P.S.Case No. 58 of 2018 registered for the offences punishable under Sections 16, 18, 20, 23 of U.A.P. Act and 3/4 of Explosive Substance Act.
Allegation against the petitioner is that while police raided a place and arrested one Gurucharan Soren, who disclosed the names of other accused persons, including the petitioner and further 40 kg. of explosive substance were recovered from the house the said Gurucharan Soren and petitioner is accused in one more case.
Submission of learned counsel for the petitioner is that except confessional statement there is nothing against the
Patna High Court Cr.Misc. No.39229 of 2018 (3) dt.03-08-2018 2/2 petitioner and petitioner is on bail in another case. Heard learned APP also.
Having heard both sides and in view of serious nature of allegation and further petitioner has criminal antecedent, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
