Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 406 and 409/34 of the Indian Penal Code.
The informant is present in Court in pursuance of order dated 29.10.2018. He could not explain that how the petitioner, who is a bank staff, is involved in payment of money to some fictitious person than the account holder, unless there is complaint of the account holder.

No.37726 of 2018(6) dt.29-11-2018 2/2 Submission of learned counsel for the petitioner is that none of the beneficiaries named in the FIR have stated before the officer inquiring the matter or the Investigating Officer that their money was not paid to them, rather they filed the affidavit also that they have received the amount. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sono (Charkapathar) Police Station Case No. 58 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
