The petitioner seeks anticipatory bail in connection with Shikarpur P.S. Case No. 558 of 2019 registered for the offence punishable under Sections 420, 406, 409/34 of the Indian Penal Code.
The prosecution case alleges that the accused persons, altogether 21 in number, including this petitioner, have taken deposits from several persons, including the informant, and misappropriated the amount under the garb of deposits in Swarn India Multi State Credit Co-operative Society Limited. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.55678 of 2021(6) dt.31-08-2022 2/2 case. It is further submitted that petitioner was working in the company in question as clerk and she had nothing to do with the company affairs and deposit and withdrawal of money. The petitioner had resigned from the company much prior to the case instituted against the employees of the company and just because she was working in the company for her livelihood she has been made accused in this case.
Learned senior counsel appearing for the E.O.U. opposes the prayer for anticipatory bail and submits that it is a case of misappropriation of huge money of the investors and crorers and crores of rupees have been misappropriated by the accused persons, including this petitioner.
Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
