The petitioner seeks bail in Atri P.S. Case No. 338 of 2018, instituted for the offence under Section(s)272, 273 IPC and Section 30(a) of Bihar Prohibition of Excise Act, 2016. It is alleged in the written report that 54 litres of foreign liquor has been recovered from Bolero vehicle. The name of petitioner has been disclosed by co-accused Abhishek Kumar and Sandeep Kumar.

Counsel for the petitioner submits that there is no recovery of any illicit liquor from possession of the petitioner. Petitioner is in custody since 15.6.2019 having clean antecedent.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.43365 of 2019(2) dt.18-07-2019 2/2 of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Atri P.S.
