JUSTICE SATYAVRAT VERMA ORAL ORDER 23-02-2022 Heard learned counsel for the petitioner and Shri Narsingh Tanti, learned A.P.P. for the State. The petitioner seeks bail in connection with Baruraj P.S. Case No. 77 of 2021 instituted for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.05.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the informant in the F.I.R. alleges that four unknown criminals snatched his bag containing sanitizer, mobile, clothes and Rs. 20,255/- on gun point.

Learned counsel for the petitioner submits that the F.I.R. was against unknown, the name of this petitioner

Patna High Court CR. MISC. No.56177 of 2021(2) dt.23-02-2022 2/2 transpired in the confessional statement of co-accused and neither any incriminating article was recovered from his possession nor the he was put on T.I.P.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 14.05.2021, charge-sheet has been submitted in the case, his name came in the confessional statement of co-accused and he was not put on T.I.P., let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Muzaffarpur in connection with Baruraj P.S. Case No. 77 of 2021.
