JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-07-2021 Heard learned Counsel for the parties concerned. The present writ application has been filed for a direction to the respondents to consider the service of the petitioner for pension scheme in the same manner as has been given to other similarly situated persons appointed by the same list and make the payment of entire retiral benefits to the petitioner on account of his superannuation with effect from 31.12.2019.

Learned Counsel for the petitioner submits that similarly situated persons, who were appointed from the same very panel of the list of 1991, are receiving all service benefits

Patna High Court CWJC No.2335 of 2021(2) dt.22-07-2021 2/2 as well as consequential financial benefit including the arrears of salary, revised salary, A.C.P. along with pension benefit. He further submits that the case of the petitioner is fully covered by the order of this Court, dated 16.06.2020, passed in CWJC Nos. 10488 of 2019, 10490 of 2019, 11168 of 2019 and order, dated 17.06.2020, passed in CWJC No. 11204 of 2019. Learned Counsel for the State admits that the case of the writ petitioner is covered by the earlier orders of this Court passed in the writ petitions preferred by the similarly situated persons and this writ application may be disposed of in the same terms.

In that view of the matter, this writ application is disposed of exactly in terms of the order of this Court, dated 16.06.2020, passed in CWJC Nos. 10488 of 2019, 10490 of 2019, 11168 of 2019 and order, dated 17.06.2020, passed in CWJC No. 11204 of 2019.
