The petitioner seeks bail in Ballia P.S. Case No. 239 of 2020, registered for the offence punishable punishable under Sections 272, 273, 120(B) and 34 of the Indian Penal Code and sections 30, 32 of the Bihar Prohibition and Excise Act, 2018. 319 litres of foreign liquor has been recovered from a truck.

It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and has got no concern with the seized liquor. Petitioner is in custody since 02.08.2021 having no criminal antecedent, as stated in para 3 of the petition. Investigation is complete.
