The petitioner seeks Anticipatory bail in connection with Ghoshi (Okari O.P.) P.S. Case No. 237 of 2017 registered under Sections 406, 409 and 420 of the Indian Penal Code. Petitioner has been implicated in this case as he was the In-charge of Primary Health Centre and payment made to some employees who were either dismissed from service or remained absent. It has been submitted that order of dismissal was set aside and salary bill is prepared by the Head Clerk and salary is directly paid in the salary account of Bank. Steps have been taken to recover excess amount paid to employees. Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named
Patna High Court Cr.Misc. No.41923 of 2018(5) dt.13-09-2018 2/2 above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad, in connection with Ghoshi (Okari O.P.) P.S. Case No. 237 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
