The petitioner apprehends his arrest in Giriyak (Katrisarai) P.S. Case No. 273 of 2016 registered for the offences punishable under Sections 420, 467, 468, 471, 120B of the Indian Penal Code and under Section 66 of the I.T. Act. The police officer, informant, arrested three persons namely Bipin Kumar, Vikas Kumar and Sonu Kumar. On interrogation they disclosed that they are indulged in cheating by playing the game "Chehra Pahchano Inaam Pao". The apprehended accused disclosed the name of the petitioner Sonu @ Praveen Kumar along with Chandan Kumar and others that they are also involved in the game.

Learned counsel for the petitioner submits that the house of the petitioner was searched and from the seizure list as it

No.14152 of 2017 (3) dt.30-06-2017 2/2 appears from page 21 of the case diary that, one diary with name and mobile numbers of some persons, one PAN card, ATM card and passbook of PNB were recovered. PAN card, ATM card and passbook belonged to the petitioner but, there is no material to show that the petitioner is also involved in cheating along with other accused persons. Even during course of investigation none of the witness has disclosed the name of the petitioner as the person who cheated anyone.

Learned APP did not dispute the facts.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Nalana in Giriyak (Katrisarai) P.S. Case No. 273 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
