2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 379 of the Indian Penal Code, registered in connection with Pranpur P.S. Case No. 226 of 2023.

3. As per prosecution case, some unknown miscreants have stolen the motorcycle of the informant.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. Petitioner is not named in the FIR rather the same has been lodged against unknown person. On the basis of suspicion and due to his criminal antecedents, the name of the

Patna High Court CR. MISC. No.51144 of 2024(3) dt.23-09-2024 2/2 petitioner has transpired in this case. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 10.01.2024.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Pranpur P.S. Case No. 226 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court further with a condition that:- (i) Before accepting the bail bond, the criminal antecedent(s) of the petitioner shall be verified from all the Police Station of Katihar District. If it is found that he is involved in any other case except which has been mentioned in para-3 of the bail petition, his bail bond shall not be accepted.
