1. The present writ application has been filed by the petitioner seeking a direction upon the respondents to fix the pay of the petitioner and other teachers alike in view of letter no. 882 dated 21.05.2012 in order to remove the pay anomaly of the petitioner and other teachers.

2. A counter affidavit has been filed and Mr. Parijat Saurav, AC to AAG-13, submits that proposal for removal of anomaly in pay fixation was sent by the District Education Officer to the Finance Department through a letter but relevant files in this regard were not sent by him. He further submits that

Patna High Court CWJC No.14134 of 2016(6) dt.05-09-2024 2/2 another letter has been sent to the Finance Department vide letter no. 280, dated 21.06.2024, for removal of anomaly in pay fixation of petitioner and other identical teachers, however, he submits that again file was not sent by District Education Officer to the Finance Department as per his instruction and the matter is likely to be settled in eight weeks.

In view of the aforesaid submission, the decision in consultation with the Finance Department by the concerned respondents should be taken in respect of the claim of the petitioner and other teachers within a period of three months from the date of receipt/production of a copy of this order. Necessary steps for sending the file to the Finance Department shall be taken by District Education Officer, Bhojpur, Ara, immediately.

4. Accordingly, the present writ application is disposed with the aforesaid direction.
