The petitioner apprehends his arrest in connection with Khaira P. S. Case No. 113 of 2017 instituted under Sections 376, 511, 448, 323 of the Indian Penal Code and Sections 7 and 8 of the Protection of Children from Sexual Offences Act, 2012. The allegation, in brief, is that while informant's daughter, 13 years old, was alone in the house, the petitioner entered inside the house and made an attempt to commit rape, but she raised alarm, thereafter informant reached there and petitioner indulged in scuffling and escaped away.
Learned counsel for the petitioner submits that the informant had taken loan of Rs. 30,000/- from the petitioner and when he demanded back money, for that account, he has been
Patna High Court Cr.Misc. No.30723 of 2017 (2) dt.10-07-2017 2/2 falsely implicated in this case.
Having considered the aforesaid facts, circumstances and the nature of offence, I am not inclined to grant the petitioner pre-arrest bail.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
