JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 The petitioner seeks regular bail in connection with Ramgarhwa P.S. Case No. 36 of 2019, registered for offences punishable under Sections 304B/34 the Indian Penal Code. Petitioner happens to be husband of the deceased and allegation against him is of subjecting her to cruelty and causing her death.

It has been submitted on behalf of the petitioner that material collected in course of investigation clearly shows that the death is due to hanging and she has committed suicide and even the chargesheet has been submitted by the police under Section 306 of the Indian Penal Code and he has been in judicial custody since 29.04.2019.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court CR. MISC. No.42411 of 2019(5) dt.26-02-2020 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge, Motihari, East Champaran, in connection with Ramgarhwa P.S. Case No. 36 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
