1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Kalyanpur P.S. Case No. 359 of 2023 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of the first information report, it is apparent that the alleged article has been recovered from the tempo of co-accused Suresh Yadav. Petitioner is not the owner of the said vehicle. Further he submits that petitioner has no criminal antecedent.

4. Having considered the facts and circumstances of

No.46753 of 2023(2) dt.11-08-2023 2/2 the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Exclusive Special Excise Judge-II, Samastipur in connection with Kalyanpur P.S. Case No. 359 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
