2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) , 56 ( d ) of the Bihar Prohibition and Excise Amendement Act 2022 . 3 . It is alleged that 25.920 liters foreign liquor was recovered from seized motorcycle .
4. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case . The name of petitioner transpired on the basis of confessional statement of co-accused who was apprehended on the spot. Petitioner is neither owner nor driver of the seized motorcycle . No incriminating material has been recovered from the conscious possession of petitioner
Patna High Court CR. MISC. No.44284 of 2025(2) dt.14-07-2025 2/2 and he is no way connected with the alleged occurrence . Petitioner has got no criminal antecedent of similar nature . 5 . Learned APP for the State vehemently opposed the bail application .
6. Considering the facts of the case and circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive special Excise Judge - II Bhojpur Ara in connection with Shahpur P. S. Case No. 36 of 2017 , subject to condition as laid down under Section 482 ( 2 ) of BNSS 2023 .
