JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2015 Petitioner is languishing in custody since 20.06.2014 in a case registered for the offences punishable under Sections 302, 201, 427, 435, 34 of the I.P.C. The informant Asharfi Tanti being Dafadar received information that half burn motorcycle and dead body are lying. Subsequently F.I.R. was lodged against unknown. The name of the petitioner sprang up during investigation as victim had love affairs with the sister of the petitioner when this petitioner threatened him about three years ago. It is submitted by learned counsel for the petitioner that sister of the petitioner died long back and petitioner has been roped in the present case only on suspicion. Learned A.P.P after going through the F.I.R has not controverted the fact that accusation is based on suspicion. A statement has been made in para 3 of the

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Bhagwanpur P.S. Case No. 238 of 2013.
