The petitioners apprehend their arrest in Sarsi P.S. Case No. 37 of 2017 instituted for the offence under Sections 363 and 366 of the Indian Penal Code pending in the court of Sri D. Prakash, Judicial Magistrate, 1st Class, Purnea. Counsel for the petitioner has submitted that First Information Report has been lodged after delay of three days of the occurrence.

In the written report it is alleged that minor daughter of the informant had gone for call of nature and did not return. It is further alleged that informant learnt that his daughter was

Patna High Court Cr.Misc. No.41757 of 2018 (3) dt.07-08-2018 2/2 kidnapped by petitioner No. 1.

Case diary has been received.

The statement of victim girl recorded under Section 164 Cr. P.C. is available in the case diary. The victim girl has levelled specific allegation against all the petitioners in her kidnapping and attempting to take her to Punjab. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners.

Prayer for anticipatory bail of the petitioners stand rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
