The petitioner apprehends his arrest in connection with Saharsa Sadar P.S. Case No. 294 of 2017 instituted for the offences punishable under Sections 341, 323, 354, 307, 504/34 of the Indian Penal Code and Section 3 /4 of the Dyan Act, 1991.
The petitioner is a neighbour of the informant and the allegation is that he assaulted the informant on his head by rod. The injury report annexed as Annexure-3 of this application shows that the informant sustained one lacerated wound on the skull which is simple in nature. There is no repetition of assault from the side of the petitioner. There is also a counter case from the side
Patna High Court Cr.Misc. No.30962 of 2017 (2) dt.10-07-2017 of this petitioner vide Saharsa P.S. Case No. 299 of 2017. Considering the facts and circumstances of the case, the anticipatory bail prayer is allowed. The petitioner, above named, in the event of arrest / surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 294 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
